New Stark Law Developments

Program Description
CMS has issued another set of changes to the Stark Rules under the 2009 IPPS Final Rule. These new rules substantially change how providers and physicians can contract for services and limit "under arrangement" transactions. This webinar will provide tools to assist healthcare providers in reviewing and potentially revising arrangements with physicians in order to comply with the new provisions.

This webinar will explain the new rules and identify key areas for compliance including:
  • Revisions to the physician "stand in the shoes" requirements and impact on contracts between hospitals, other designated health services entities and physician organizations
  • Changes in "under arrangement" transactions between physicians and hospitals and other entities providing designated health services
  • Restrictions on the use of "Per Click" payments in lease arrangements
  • Changes in the use of percentage payment
  • Periods of disallowance when transactions do not meet a Stark exception
  • Alternative compliance permitted for signature requirements
  • Provisions for obstetrical malpractice subsidies and physician ownership or investment in retirement plans

Lisa M. Ohrin, Esq, Deputy Director, Division of Technical Payment Policy, CMS
Lisa Ohrin is the Deputy Director of the Division of Technical Payment Policy within the Center for Medicare Management at the Centers for Medicare & Medicaid in Baltimore, Maryland. This division is responsible for developing policy and regulations related to the physician self-referral law, issuing advisory opinions regarding the same, overseeing enforcement of Medicare-approved transplant centers, and handling a variety of statutory and regulatory Medicare payment issues. She is one of the principal drafters of the Stark Phase III regulations, the revisions to the Stark rules included in the FY 2009 Hospital Inpatient PPS Final Rule, and the proposed new exception included in the CY 2009 Physician Fee Schedule Proposed Rule.

Beth Schermer is a partner in Coppersmith Gordon Schermer & Brockelman PLC, which serves as general counsel to AzHHA. For over twenty-five years, Beth has represented healthcare systems, hospitals and provider groups on regulatory matters under the anti-kickback and Stark laws, healthcare business arrangements and ventures, compliance initiatives, reimbursement and billing concerns and physician contracts. Schermer speaks nationally on the legal and regulatory issues for health care transactions and is a past president of the American Health Lawyers Association.

Joel Wakefield is a partner in Coppersmith Gordon Schermer & Brockelman PLC. He counsels large hospital chains, small rural facilities and many hospitals in between on a wide array of regulatory, transactional, and operational matters. Before joining Coppersmith Gordon, Wakefield served as in-house counsel for a large multi-speciality group practice and teaching hospital in Seattle, Washington. He currently serves as the president of the Arizona Association of Health Care Attorneys

Substitution, Transfer and Cancellation Policy
Cancellations received in writing up to five business days prior to an event will be given a full refund less a $50 processing fee. No refunds will be given for cancellations received less than five business days prior and day-of-program no-shows. Substitutions are accepted.
