Waivers to Continue Until May 11 Despite Biden Signing Legislation to End COVID-19 National Emergency
On April 10, President Joe Biden signed legislation passed by Congress to formally end the COVID-19 national emergency. Despite that action, CMS put out an update clarifying that public health emergency waivers will continue until May 11, as HHS has previously announced.
"To be clear, the federal Public Health Emergency (PHE) for COVID-19 declared under section 319 of the Public Health Service Act, is not the same as the COVID-19 National Emergency declared by the Trump Administration in 2020 and implicated by H.J.Res.7. Therefore, an end to the COVID-19 National Emergency does not impact current operations at HHS and does not impact the planned May 11 expiration of the federal PHE for COVID-19 or any associated unwinding plans," the statement from CMS said.
WHA continues to advocate with Congress for maintaining important waiver flexibilities permanently and will be bringing that message to Capitol Hill again in a few short weeks with a number of our hospital leaders.
